1. Area of application

For all deliveries from HOCK Design e.K. to end consumers ( § 13 BGB) these general terms and conditions apply for the region of the European Union.

3. Offer and conclusion of contract

3.1 The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to order. All offers apply "while stocks last", unless the products state otherwise. Subject to errors.

3.2 By clicking the "Send order" button in the last step of the ordering process, you are placing a binding order for the goods contained in the shopping cart. The purchase contract is concluded when we accept your order by sending an order confirmation by email immediately after receiving your order.

The contract text is saved on our internal systems. You can view the general terms and conditions at any time on this page. The order data and the terms and conditions will be sent to you by email.


5. Right of withdrawal

Consumers (§ 13 BGB) have a statutory right of withdrawal.


Cancellation policy
You can cancel your contract declaration within 14 days without giving reasons in text form (e.g. letter, email) or – if the item is left to you before the deadline – by returning the item. The period begins after receipt of this instruction in text form, however not before receipt of the goods by the recipient (in the case of the recurring delivery of similar goods not before receipt of the first partial delivery) and also not before fulfillment of our information obligations in accordance with Section 312c (2) BGB in conjunction with Section 1 paragraph 1, 2 and 4 BGB- InfoV as well as our obligations according to § 312e paragraph 1 sentence 1 BGB in connection with § 3 BGB- InfoV . To meet the cancellation deadline, it is sufficient to send the cancellation or the item in good time.

Exclusion of revocation

The right of revocation does not exist for contracts:

a. for the delivery of goods that are made according to customer specifications or clearly on the personal needs are tailored or because of their nature are not suitable for a return or can spoil quickly or whose expiry date would be exceeded

b. if you are an entrepreneur within the meaning of Section 14 of the German Civil Code (BGB) and act in the exercise of your commercial or self-employed activity when concluding the contract.

Consequences of cancellation

If you cancel this contract, we will return all payments we have received from you, including delivery costs (with the exception of the additional costs that result from the fact that you chose a different type of delivery than the cheapest standard delivery we offer). We will return the amount immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract and well received the goods returned in good condition. For this repayment, we use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. We can refuse the repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You must return or hand over the goods to us immediately and in any event no later than fourteen days from the date on which you inform us of the cancellation of this contract. The deadline is met if you send off the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the nature, properties and functionality of the goods.

6. Prices and shipping costs

6.1 The prices stated on the article pages include German VAT 19% and other price components.

6.2 The shipping costs depend on the amount of the ordered goods and the type of shipping and will be clearly communicated to you before you place your binding order.


7. Delivery

7.1 Delivery takes place only within Germany and other European countries.

7.2 The delivery time is 3-5 working days. We point out any delivery times on the respective product page. HOCK Design e.K. has no influence on shipping problems of service providers or for special reasons of force majeure and do not entitle to compensation.

8. Payment terms

All prices stated in the online shop of HOCK Design e.K. include 19% German VAT. The price also includes all other price components apart from the additionally stated shipping costs. The corresponding shipping costs, as well as information about taxes and costs that are not charged by HOCK Design e.K., will be communicated to you as part of the ordering process. If you are in arrears with payment, default interest of 5% above the base rate of the European Central Bank must be paid. You can only offset against an undisputed or legally established claim. You can only exercise a right of retention if your counterclaim is based on the same contractual relationship.

9. Retention of title

The goods remain our property until full payment.

10. Warranty

The warranty is based on the European statutory provisions.
